Terms of Service

Please read these Terms carefully before using the Khonza Marketplace. By registering an account or placing/accepting an order, you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. Definitions
- “Khonza” — Khonza Marketplace (Pty) Ltd, operator of khonza.online.
- “Platform” — the Khonza website and mobile application.
- “Customer” — a registered user who books services.
- “Service Provider” — a verified individual or business offering services on the platform.
- “Order” — a confirmed booking for a service.
- “Listing” — a service advertised by a Service Provider on the platform.
2. Eligibility
- You must be at least 18 years old to create an account.
- Service Providers must be legally permitted to offer the services they list in the relevant area.
- You must provide accurate, current, and complete information during registration.
3. The Khonza Marketplace
Khonza is a marketplace platform — we connect Customers with independent Service Providers. Khonza is not a party to the service contract between Customer and Service Provider, and is not responsible for the quality, safety, legality, or completion of any service.
Service Providers are independent contractors, not employees or agents of Khonza.
4. Accounts
- You are responsible for maintaining the confidentiality of your password.
- You must notify us immediately of any unauthorised use of your account.
- One person may not hold more than one Customer account without our written consent.
- We may suspend or terminate an account that violates these Terms or applicable law.
5. Service Provider Obligations
- Service Providers must complete Khonza’s verification process before their listings go live.
- Listings must accurately describe the service, pricing, and availability.
- Service Providers must hold any licences, permits, or insurance required by South African law for their trade.
- Service Providers may not solicit Customers to transact off-platform to circumvent Khonza’s commission.
6. Pricing, Payments & Commission
- All prices displayed are in South African Rand (ZAR) and include VAT at the applicable rate.
- Payments are processed by Yoco. By making a payment, you also agree to Yoco’s Terms.
- Khonza deducts a platform commission from each completed order as displayed on the Service Provider dashboard.
- Commission rates are shown to Service Providers during onboarding and may be updated with 30 days’ notice.
7. Cancellations & Refunds
- Cancellation policies are set per Listing by the Service Provider and are shown before checkout.
- Where a Service Provider cancels or fails to arrive, the Customer is entitled to a full refund.
- Disputes that cannot be resolved between the parties may be escalated to Khonza support. Khonza’s decision on refunds is final for platform-mediated disputes.
- Refunds are processed via the original payment method within 5–7 business days.
8. Reviews & Community Forum
- Reviews must be honest and based on genuine experience. False or defamatory reviews will be removed.
- Forum posts must comply with our Community Guidelines: no hate speech, harassment, spam, or illegal content.
- Khonza reserves the right to remove content and suspend accounts that violate these standards.
9. Intellectual Property
All platform content (logos, design, code) is owned by Khonza and may not be copied, modified, or distributed without written permission. Service Providers retain ownership of their Listing content but grant Khonza a non-exclusive, royalty-free licence to display it on the platform.
10. Prohibited Conduct
You may not:
- Use the platform for any unlawful purpose or in violation of any South African law.
- Scrape, crawl, or systematically download platform content without authorisation.
- Attempt to gain unauthorised access to any part of the platform or its underlying systems.
- Impersonate another person or entity.
- Post false, misleading, or fraudulent content.
- Transmit viruses or any malicious code.
11. Limitation of Liability
To the maximum extent permitted by South African law (including the Consumer Protection Act 68 of 2008), Khonza’s total liability for any claim arising from use of the platform shall not exceed the greater of (a) the commission Khonza received from the relevant Order, or (b) R 500. Khonza is not liable for indirect, incidental, or consequential damages.
Nothing in these Terms limits liability for death or personal injury caused by gross negligence or wilful misconduct.
12. Indemnity
You agree to indemnify and hold harmless Khonza, its directors, and employees from any claim, loss, or expense (including legal fees) arising from your use of the platform, breach of these Terms, or infringement of any third-party right.
13. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
14. Governing Law & Disputes
These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved informally shall be referred to the South Gauteng High Court or, where applicable, the Small Claims Court having jurisdiction.
Khonza will first attempt to resolve any dispute amicably within 30 days of receiving written notice.
15. Consumer Protection Act (CPA)
Where you qualify as a “consumer” under the Consumer Protection Act 68 of 2008, nothing in these Terms limits or excludes any right you have under that Act. The National Consumer Commission can be reached at thencc.gov.za.
16. Changes to These Terms
We may update these Terms at any time. Material changes will be notified by email or a prominent platform notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
